ARTICLE 2 – SCOPE OF APPLICATION
These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales concluded by the company Néoné with consumers and non-professional buyers via its website.
Any order implies unreserved acceptance of these GTC.
ARTICLE 3 – PRODUCTS
The products offered are items intended for babies (excluding food products), notably:
- accessories
- textiles
- toys
- equipment
The essential characteristics are described on each product sheet.
Compliance and safety:
The products comply with current European standards (CE marking where applicable).
Warning:
Products must be used under adult supervision.
ARTICLE 4 – PRICES
Prices are indicated in euros (€), all taxes included (TTC).
Delivery costs are specified before order validation.
The company reserves the right to modify its prices at any time, but the applicable price remains that validated at the time of the order.
ARTICLE 5 – ORDER
The customer places an order online.
The order is validated after:
- Acceptance of the GTC
- Full payment
A confirmation email is sent.
Néoné reserves the right to refuse an order in case of:
- Previous dispute
- Suspicion of fraud
ARTICLE 6 – PAYMENT
Payment is due immediately.
Accepted payment methods:
- Bank card (via secure provider)
- PayPal
- Other secure solutions
Banking data is never stored.
ARTICLE 7 – DELIVERY
Products are delivered to the address indicated by the customer.
Estimated delivery times:
- 5 to 15 working days (may vary depending on suppliers and destination)
IMPORTANT (dropshipping):
Some products may be shipped directly from partner suppliers located outside the European Union.
The customer is informed that:
- Additional delays may apply
- Customs duties or local taxes may be required
Néoné cannot be held responsible for delays attributable to the carrier.
ARTICLE 8 – TRANSFER OF RISKS
The transfer of risks occurs when the customer physically takes possession of the product.
ARTICLE 9 – RIGHT OF WITHDRAWAL
In accordance with articles L221-18 et seq. of the Consumer Code:
The customer has a period of 14 days to exercise their right of withdrawal without justification.
Return conditions:
- Unused product
- In its original condition
- In its original packaging
Return costs are the responsibility of the customer.
Refund:
Made within 14 days after receipt of the returned product.
ARTICLE 10 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply in particular to:
- Products opened for hygiene reasons (e.g., baby textiles if used)
- Personalized products
ARTICLE 11 – RETURNS – DEFECTIVE PRODUCTS
In case of a defective or non-compliant product:
The customer must contact customer service with proof (photos).
A solution will be offered:
- Replacement
- Refund
Return costs may be covered.
ARTICLE 12 – LEGAL GUARANTEES
The customer benefits from:
Legal guarantee of conformity (articles L217-3 to L217-20)
Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code)
ARTICLE 13 – LIABILITY
Néoné cannot be held responsible for:
- Improper use of products
- Non-compliant use
- Indirect damages
Products must always be used under adult supervision.
ARTICLE 14 – PERSONAL DATA (GDPR)
The data collected is necessary for order processing.
In accordance with the GDPR, the customer has:
- Right of access
- Right of rectification
- Right of erasure
- Right of opposition
Data is never resold.
ARTICLE 15 – INTELLECTUAL PROPERTY
All elements of the site are protected.
Any reproduction is prohibited without authorization.
ARTICLE 16 – MEDIATION
In accordance with article L612-1 of the Consumer Code:
The customer can use a consumer mediator free of charge.

ARTICLE 17 – FORCE MAJEURE
The company cannot be held responsible in case of an unforeseeable and irresistible event (strike, disaster, pandemic, etc.).
ARTICLE 18 – APPLICABLE LAW

In case of dispute, jurisdiction is attributed to French courts.
